As already indicated by the Federal Office of Justice, the new Swiss Data Protection Act (LPD) will enter into force on September 1, 2023. The Federal Council still had to make the decision and it has now been done. Originally, the new LPD was planned for the second half of 2022, while the text was accepted by both federal chambers in September 2020.
In their press release, the federal authorities explain that they have chosen to wait until September 1, 2023 to give economic circles enough time to take the necessary steps. “This one-year period will give data protection officials enough time to do what is necessary for the implementation of the new law”, specifies the press release from the Confederation.
This later entry into force than initially planned is also linked to adaptations to the new data protection ordinances (OPDo), modifications made by the Federal Council following criticism. In particular relating to data security. “[Le Conseil fédéral] set the retention period for data processing logging reports to at least one year and added a new provision which aims to harmonize the protection objectives in terms of data security with those of the new federal law of 18 December 2020 on information security”, further indicates the authorities.
