There is no peace at Hertha BSC: After investor Lars Windhorst caused a stir with a TV interview, things are probably going to get worse. He is said to have pledged his shares in the capital club.
Lars Windhorst wanted to Hertha BSC make it a “big city club”, as he said himself. But a lot has happened at the capital city club since he joined in 2019. Now “Business Insider” reports that a notary reported to Hertha at the end of last week and in a E-mail the foreclosure sale of the Dutch Peil Investment BV is said to have announced. This is the subsidiary of his Tennor Holding BV group of companies, which holds shares in the capital club. Should it become one auction come from the company, then the shares in the Bundesliga club would also be auctioned off and Lars Windhorst would no longer be an investor in the club.
As the medium further reports, it itself telephoned the notary, who announced the auction to the highest bidder and therefore probably also to a judgment of the district court in Amsterdam dated April 1, 2021 with reference C/13/689706.
Windhorst was probably unable to repay loans in 2020
Now it’s getting complicated: Lars Windhorst was in a tight spot in July 2020 and had money worries. The company “S4 Limited” allegedly granted the investor from Hertha BSC a short-term loan of 25 million euros. According to the loan agreement, the repayment had to be made within 30 days – plus two million euros in interest. But exactly this case should not have occurred, which is why, according to Article 4.2 of the contract between “S4 Limited” and Tennor, the pledging of Peil Investment should take effect.
According to the judgment of the district court in Amsterdam, “Tennor […] fails to repay the loan amount and interest by August 31, 2020. On September 10, 2020, Tennor paid an amount of 10 million euros to S4 Limited.” The company then tried to take legal action to enforce the remaining claim once morest Tennor. According to “Business Insider”, the “Rechtsbank Amsterdam” then decided on September 1 April 2021 on behalf of the king that the responsible notary has to organize and carry out a foreclosure sale of Peil Investment. In addition, the district court in Amsterdam is said to have confirmed to the medium that the judgment is final and will not be appealed.
Windhorst spokesman is said to have denied the pledging
The notary therefore now sent an email to Hertha to inquire regarding the value of Peil Investment’s shares. The foreclosure might therefore probably be stopped at any time by an out-of-court settlement.
A spokesman for Windhorst is said to have initially denied the pledge to the medium and later wrote that “the process you describe” therefore “does not correspond to the current facts” but is “done”. The notary allegedly said nothing to “Business Insider” regarding the completion of the process. Accordingly, the online medium from the club’s environment claims to have learned that the pledging of the shares in the room may have been unfaithful.
