The plenary session of the Congress of the Republic returned this Tuesday, April 16, to have in its hands the immunity of the judges of the Supreme Electoral Tribunal (TSE). Parliament scheduled for the session to integrate the two investigative commissions to evaluate the two pre-trials.
The session, scheduled for 2 p.m., and the integration of the commissions were part of the main points on the agenda. Precisely in the fourth and fifth point of the plenary session.
The electoral magistrates once once more faced pretrial processes following the plenary session of the Supreme Court of Justice (CSJ) processed two new complaints. But although there are amparo actions that question the procedure, Congress was obliged to know the files and integrate the investigative commissions.
The first pretrial goes once morest the five titular magistrates of the TSE, Blanca Alfaro, the current president, along with Rafael Rojas, Irma Palencia, Mynor Franco and Gabriel Aguilera. The last four cannot exercise their role due to a court resolution because they are subject to criminal proceedings within the Trep case.
The second pretrial is once morest the main magistrates Irma Palencia, Mynor Franco and the substitute magistrate Álvaro Cordón. Until now, it is known that judges Palencia and Cordón filed amparo actions questioning the processing of the amparo.
The commissions
The first investigative commission, once morest the five titular magistrates, will have as president and secretary the independent deputies, elected by Movimiento Semilla, Luis Cáceres and Román Castellanos, respectively. As members are the deputies Mario Gálvez from the UNE, Rodrigo Pellecer from Comunidad Elefante and Mynor de la Rosa from the Vamos bloc.
The second commission, once morest two incumbents and a substitute, was left with deputy Christian Joél Martínez, from the Vamos bloc, as president; Luis Javier López, from the UNE, as secretary; while the members are Nery Rodas from Cabal, Luis Ventura, independent representative elected by Movimiento Semilla, and Gerardín Díaz from Valor.
The facts
In the first complaint, the National Unit of Hope (UNE) questions the minutes of the second electoral round for doubting the final results. The UNE presidential candidate, Sandra Torres, lost to Bernardo Arévalo in the August 20 vote.
In the second complaint, the judges who accepted the registration of Manuel Baldizón as a candidate for deputy are attacked. Despite the fact that he was convicted of money laundering in the United States, some judges left aside criteria of honorability and suitability for his registration.
Baldizón lasted a few days as a candidate for deputy because the Plenary of the TSE retracted its decision and annulled the registration. But according to Judge Cordón, this preliminary ruling has no reason to exist.
The official explained through documents that he presented, along with an action for protection to the Constitutional Court (CC) and information that he transferred to Congress, that this complaint was already known in 2023. Advocating the principle that no one can be tried twice by the same facts.
The official’s documentation shows that the previous CSJ was aware of the complaint and rejected it, but the accusations regarding the registration of Manuel Baldizón were presented physically and digitally, the second complaint being the one that was recently submitted to the CSJ where it is now The Plenary decided to admit it for processing.
