The deputy for the Antofagasta Region, José Miguel Castro (RN), asked to investigate – through an official letter – a complaint that argues that the government had issued a Purchase Order for $235,200,000 to hire a law firm and defend irregular migrants , a contract that would have been formalized by OC N°1333-49-SE23 of December 22, 2023.
According to the parliamentarian and member of the Security commission, “This acquisition, if its veracity is confirmed, would be quite serious, and would generate a significant impact on citizens, especially in a context in which crime rates are worsening in our country.”
In this sense, it is worth remembering that following the Metropolitan Region, Antofagasta is the second in the country seriously affected by the phenomenon of irregular or clandestine immigration, and that it experiences consequences such as the entry of people with a criminal history, the presence of criminal organizations and the occurrence of events of high social connotation, such as human trafficking, kidnappings, homicides, extortion and drug trafficking.
Deputy Castro considers that this acquisition contradicts the will of the Legislative Body, and of the citizens, since recently the Chamber of Deputies approved a bill that sanctions clandestine entry into the national territory as a crime, constituting itself as a containment mechanism once morest this phenomenon, a legal initiative that is already in the Senate.
Due to the above, the legislator requested the Minister of the Interior and the Minister of Justice and Human Rights to provide the following information:
Inform regarding the foundations and circumstances that would explain the acquisition carried out by the Public Criminal Defender’s Office of the Antofagasta Region through the individualized Purchase Order.
Detail the acquisition process, including the contracting modality (direct treatment or bidding), the identification of the offers received, if applicable, and the foundations that would explain the choice of the assignee of the resources: Araya and Ángulo associates.
Inform regarding the way in which this acquisition would be used to represent people of foreign nationality who might be charged with the crime of clandestine entry into the national territory, assuming its hypothetical approval and validity as law.
Finally, the parliamentarian asked that the responses be “clear and transparent regarding this complaint” which, if true, in his opinion would be “very serious”, and urged the authorities to respond in an agile and concrete manner regarding this possible contract; “At a time when the bill that criminalizes clandestine entry into our country is advancing, we cannot afford to lose more than 200 million pesos in this type of completely ideological actions. We want to know if this is truth and analyze it urgently.”
