The Guinea Bar has spoken out on the internet restrictions and blocking of social networks observed since November 24, 2023. In a statement published this Wednesday, December 13, the council of the bar association deplored the comments from the government spokesperson who maintained that “the internet is not a right”. For almost three weeks, the Guinea Bar has noted a restriction on access and use of the Internet throughout the national territory.
In addition to infringing on the fundamental rights of citizens, the limitations imposed on the internet have excessively harmful repercussions on the national economy.
The Guinea Bar invites the authorities to strictly respect freedom of communication and expression online and offline, to restore access and use of electronic communication networks.
Indeed, articles 8 and 19 of the Transition Charter respectively provide
“Fundamental rights and freedoms are recognized and their exercise is guaranteed to citizens under the conditions and forms provided for by law. No exceptional or emergency situation should justify human rights violations.”
“Every individual has the right to be informed freely and to be informed.” LThe Guinea Bar therefore recalls, within the meaning of these texts, that even in a period of transition, respect for the fundamental rights of citizens is not a negotiable subject.
In any case, the subsequent support of the people of Guinea for the breakdown of constitutional order on September 5, 2021 was only motivated by their deep and legitimate hope for a better future.
A future where every daughter and son of Guinea hopes to live in a secure, stable environment that respects their rights and freedoms, particularly the right to information by all means, including New Information Technologies.
The restriction of the internet and social networks is a blatant manifestation of the violation of the right to information, freedom of the press and freedom of opinion.
The Guinea Bar particularly reminds the Minister of Posts, Telecommunications and the Digital Economy, government spokesperson that, in all civilized societies, access to the “internet” is perceived, admitted and imposed as a fundamental right.
The Internet is a means of communication in the public domain that the State has the mission of guaranteeing to everyone and in all circumstances.
