“International Justice” orders Israel to take measures to allow aid to enter Gaza

The Hague – Yesterday, Thursday, the International Court of Justice ordered Israel to take all necessary and effective measures without delay to ensure the provision of necessary humanitarian aid to the Palestinian Gaza Strip.

The International Justice Department stated, in a statement, that it had issued an order for new measures in the “genocide” case brought by South Africa once morest Israel.

In its new decision, the court called on the Israeli army not to violate the rights of the Palestinians, a “protected group” under the Genocide Convention, including not to obstruct the delivery of badly needed humanitarian aid in Gaza.

The resolution noted that since January 26, 2024, “the catastrophic living conditions of Palestinians in the Gaza Strip have worsened, in particular due to the long-term and widespread deprivation of Palestinians in Gaza of food and other essentials.”

He added, “The court notes that the Palestinians in Gaza no longer only face the threat of famine, but that this famine has already appeared.”

The decision confirmed that the situation in Gaza has deteriorated since the issuance of the judicial order on January 26, 2024, which necessitated the imposition of new measures.

The court reaffirmed the validity of its decision issued on January 26, demanding “the immediate and effective implementation of the measures applied to the entire Gaza Strip, including the city of Rafah.”

– Delivery of aid

The court ruled on three new measures “taking into account the deteriorating living conditions faced by Palestinians in Gaza, in particular the spread of famine and hunger.”

Accordingly, the court requested that Israel “in full cooperation with the United Nations, provide the basic services that Palestinians in Gaza urgently need, including food, water, electricity, fuel, shelter, clothing, and hygiene needs, in addition to medical supplies and medical care.”

It also asked Tel Aviv “to take all necessary and effective measures, without delay, to ensure the unhindered provision of humanitarian aid by all parties concerned, including increasing the capacity and number of land crossing points and keeping them open for as long as necessary.”

The decision of the International Court of Justice was unanimously approved by all of the court’s judges, including a female judge who ruled differently than the other judges in the first decision issued by the International Court once morest Israel.

– Not violating rights

In its second order, the court asked the Israeli army “not to violate the rights of Palestinians in Gaza, a group protected under the Genocide Convention, in any way, including not to prevent the delivery of necessary humanitarian aid to Gaza.”

In its third precautionary decision, the Court decided that Israel must inform the Court within one month of the measures taken regarding the additional measures taken.

The second additional measure in the decision was opposed by Ugandan Judge Julia Sibutende and Israeli interim judge Aharon Barak.

However, the third additional precautionary decision was rejected only by the temporary Israeli judge.

The court stated that it might not decide on the measures requested by South Africa regarding the ceasefire in Gaza, under the pretext that “the decision will not bind third parties,” in reference to the Hamas movement.

On March 6, South Africa asked the International Court of Justice to take additional emergency measures once morest Israel due to the “large-scale famine” that resulted from its fierce war once morest the Gaza Strip.

This is the third request submitted by South Africa once morest Israel to the court, which is the highest judicial body in the United Nations, since Tel Aviv began its devastating war on the Gaza Strip regarding 6 months ago.

In response to the case filed by South Africa on December 29, 2023, the International Court of Justice, on January 26, ordered Tel Aviv to take “measures to prevent acts of genocide once morest Palestinians and improve the humanitarian situation in the Gaza Strip.”

– Report within a month

The court also ordered Israel to submit a report within a month of the issuance of the decision regarding the extent to which it has implemented these measures.

In violation of international laws, Israel restricts the access of humanitarian aid to Gaza, especially by land, which has caused a scarcity of food, medicine and fuel supplies and created a famine that has claimed the lives of children and the elderly in the Strip, which it has besieged for 17 years, and which is inhabited by regarding 2.3 million Palestinians in catastrophic conditions.
