International Justice issues advisory opinion on Israel’s practices in Palestine

The Hague – The International Court of Justice confirmed, yesterday, Friday, that it “will issue an advisory opinion on the legal consequences related to Israeli measures in the occupied Palestinian territories on July 19.”

The court said in a statement that “we will issue our advisory opinion regarding the legal consequences arising from Israel’s policies and practices in the Occupied Palestinian Territory, including East Jerusalem.”

The statement explained that “the court will hold a session at 3:00 pm local time at the Peace Palace in The Hague (the court’s headquarters), during which Judge Nawaf Salam, the court’s president, will read the advisory opinion.”

​​​​​​On 30 December 2022, the United Nations General Assembly adopted a resolution requesting the International Court of Justice to issue an advisory opinion on the legal consequences arising from the Israeli occupation of the Palestinian territories since 1967, how Israel’s practices affect the legal status of the occupation and what the legal consequences of this situation are for all States and the United Nations.

The duties of the Court, the principal judicial organ of the United Nations, include, first, resolving legal disputes between States in accordance with international law, and, second, giving an advisory opinion on legal questions referred to it.

The International Court of Justice may be requested by bodies accredited to the United Nations to give an advisory opinion on a question of international law, provided that it is relevant to the organs of the United Nations and their fields of activity. States may not request an advisory opinion from the Court.

Although the advisory opinion is not binding, it is very important because it reflects the opinion of the International Court of Justice on the issue, and while it indicates how the Court might decide potential cases, it is also effective in creating political pressure on states that oppose that opinion.
