Instructions: a consultation method contrary to the spirit of the law, calling for increased vigilance

The law on the fight once morest waste and the circular economy (“AGEC“) had planned it: it is in 2023 that the debate on the implementation of deposit systems for recycling or reuse.

However, the legislator had required the prior submission of a report by Ademe before the start of the consultation with the stakeholders. By starting this one without having the necessary elements of expertise, the commission regrets that the Government has chosen to act out of order. This reconsideration of the schedule, contrary to the spirit of the law voted in 2020, is all the more damaging as other parts of the text have since been delayed (establishment of REP sectors, deployment of “out-of-home” collection, etc.), due in particular to the health crisis.

Therefore, the commission will exercise on this consultation a enhanced vigilance and will show up careful that the debate already under way is as complete as possible. For example, the advisability of a deposit for recycling plastic bottles will have to be assessed globally and in a balanced way, with regard to the objective of 90% collection for recycling in 2029, but also that – even more decisive in circular economy – from 50% reduction in the number of single-use plastic bottles by 2030. Finally, the evaluation cannot disregard the context marked by the generalization of the yellow bac for all French people in 2023 : a deposit for recycling should not not nullify the efforts to simplify the gesture of sortingby introducing a source of complexity for our citizens.

For Marta de Cidrac, rapporteur at the time of the AGEC bill and president of the “Circular Economy” study group: “this out-of-order start of work is a bad signal. When examining the AGEC law, we felt that the deposit for recycling plastic bottles would be an ecological regression and a double penalty for the consumer and the local taxpayer. We will therefore be particularly vigilant as to the exhaustiveness of this debate with, as a priority, the effectiveness of our circular economy model”.
