Flanders and Wallonia had decided to cap the indexation of rents for any housing whose EPB certificate, intended to measure energy performance, displays a level D or lower. In Flanders, a total ban on indexation is in force from a level E certificate, while in Wallonia and Brussels such a measure is in place from a PEB F.
In May, the National Syndicate of Owners and Co-owners and Verenigde Eigenaars had lodged proceedings for annulment before the Constitutional Court with a view to having the legislation adopted at the level of each Region annulled. In particular, they dispute the reliability of EPB certificates.
