Indonesian Anti-Graft Agency Left in Limbo as DPR Puts Brakes on KPK Leadership Vote

DEPUTY Chairman of the DPR, Sufmi Dasco Ahmad, said that the results of the selection of Leadership Candidates (Capim) and Candidates for the KPK Supervisory Board had not yet been processed in parliament. Dasco revealed a number of reasons why the DPR had not processed the recommendations from the KPK selection results.

He said that the DPR commission to process the KPK candidate had not yet been formed. Also, the new DPR equipment (AKD) and commissions will be announced on October 14.

Apart from that, he also doesn’t know whether the letter from President Jokowi regarding the KPK chief has been sent to the DPR.

“Yes, a commission has not yet been formed. Secondly, I have not monitored whether the letter from the President has been sent to the DPR,” said Dasco in Jakarta, Monday (7/10).

Dasco was reluctant to explain further whether the selection process for the KPK chief in the DPR would take place before or after Prabowo Subianto was inaugurated as President of the Republic of Indonesia on 20 October. “We don’t yet know the situation and conditions,” he said.

Previously, the Coordinator of the Indonesian Anti-Corruption Society (MAKI) Boyamin Saiman considered that President Joko Widodo (Jokowi) did not have the right to send the results of the selection of Leadership Candidates and Candidates for the KPK Supervisory Board to the DPR. According to him, this authority lies in the hands of the elected president Prabowo Subianto.

“President Jokowi is prohibited from sending the results of the KPK Leadership Candidate Committee and KPK Dewas to the DPR because it is the authority of the President for the 2024-2029 period, namely Prabowo Subianto. The basis for this prohibition is the decision of the Constitutional Court Number 112 / PUU-XX/ 2022 page 118 first paragraph,” said Boyamin in his statement, Thursday (3/10).

The Constitutional Court’s decision is the result of a decision on a lawsuit filed by Corruption Eradication Committee Deputy Chairperson Nurul Ghufron regarding changing the term of office for the head of the anti-corruption agency from four to five years.

Based on the Constitutional Court’s decision Number 112/PUU-XX/2022, the authority to submit the results of the selection of the KPK Chief Executive Officer and Dewas Candidates rests with the president of the next period, namely Prabowo Subianto.

Prabowo was elected head of state for the 2024-2029 period after winning the 2024 presidential election. On that basis, Boyamin asked Jokowi not to send the names of 20 KPK Leadership Candidates and Dewas Candidates to the DPR. If continued, Boyamin threatened to file a lawsuit with the State Administrative Court (PTUN).

“We will submit a subpoena or warning letter to President Jokowi not to submit the results of the KPK Leadership Candidates and KPK Dewas Candidates Committee to the DPR to avoid violations of the constitution. If this subpoena or warning is ignored, we will file a lawsuit with the State Administrative Court (PTUN) to cancel the president’s letter to the DPR,” said Boyamin.

It is known that the KPK Pansel has submitted 20 names of KPK Chief Leaders and KPK Dewas Candidates to President Jokowi on Tuesday (1/10). A total of 20 names will be submitted by Jokowi to the DPR to take part in the fit and proper test or fit and proper test. The following are 20 names of KPK Chief Leaders and Dewas Candidates:
