Indert begins judicial process to recover Chaco lands

Asuncion, IP Agency.- The National Institute for Rural and Land Development (Indert) announced that it will begin the judicial process on Wednesday to recover some 19 plots of land in Chaco in favor of the State.

“The waiting period has been met and on Wednesday the 7th we will begin the legal action to recover Chacho’s lands in favor of Indert,” said the president of the institution, Francisco Ruiz Díaz, after waiting a few days for those who stopped paying the installments for the properties that have been awarded to them.

There are 19 lots of 3,000 to 4,000 hectares in size, which will return to the hands of Indert due to being in arrears (Art. 30 of Law 2419/04). There were 26 in total and the owners of seven properties have caught up with their payments, according to the institution.

The total amount owed to Indert by the successful bidders reached the sum of 23 billion guaraníes, of which more than 18 billion guaraníes correspond to the delay in payment of the installments and 4.958 billion guaraníes to the lack of payment of the installment delivery.

Last week, the agricultural authority managed to collect overdue payments on seven plots of land for a total of 3.2 billion guaraníes, which means that the amount in arrears is reduced to less than 20 billion guaraníes.

The decision of the rural entity is based on article 53 of the Agrarian Statute, which establishes that the delay of three consecutive years causes the award to lapse and the lot to once again become available to the institution, according to the legal director of the institution, María del Carmen Cardozo.

Likewise, article 93 on non-compliance or unlawful acts determines that, failure to comply with legal obligations, the lots revert to the disposal of Indert when: a) Non-compliance with legal obligations is observed, and b) The property is not used economically and rationally for a period of more than two years.

Likewise, titled properties that have outstanding obligations are subject to the same legal provisions.

Furthermore, the Agrarian Statute establishes that the compensation route in the form of payment rations that is intended to be imposed on the Institution is not a figure established in the Law and dangerously compromises the resources necessary to carry out the agrarian reform.

Based on this background, this Wednesday, February 7, the procedures for the recovery of properties will resume, identifying, in this first phase of 2024, all cases of non-compliance linked to the Western Region or Chaco.
