With the decision of December 14th (G 352/2021), the Constitutional Court partially repealed two paragraphs of the Code of Criminal Procedure that focus on the so-called confiscation of cell phones. According to the Constitutional Court, the seizure of cell phones and mobile data carriers in criminal proceedings without prior judicial authorization is unconstitutional. This legal constellation violates the data protection law and the right to private life, which is enshrined in the ECHR.
