In case of delay in contract for space development project, ‘10% late payment’ regulation

The Ministry of Science, ICT and Future Planning (Minister Jong-ho Lee) announced on the 18th that it had made a preliminary notice of legislation on some amendments to the Enforcement Decree of the Space Development Promotion Act.

The amendment was revised in June and stipulated the matters to be delegated by the Space Development Promotion Act, which was amended in December and will be implemented in December. It contains the definition of a semi-orbital launch vehicle, expansion of the opening of space development infrastructure, limits on delay compensation, and procedures for designation of new space technologies and space industry clusters.

The limit of the total amount of delay compensation for delay in the performance of the space development project contract was stipulated as an amount equivalent to 10% of the contract amount. It is explained that the high technical difficulty of space technology was taken into consideration.

The definition of a semi-orbital launch vehicle was also revised. The scope of the sub-orbital launch vehicle mandated by the law was defined as an artificial space object designed and manufactured to rise to a height of 100 km or more above sea level by a self-propelled body and then descend again.

Designate new space technology and promote corporate technology development through preferential use. To this end, the designation procedure entrusted by the law, such as the examination deadline for designation of new space technology, examination cost, and issuance of a designation certificate, was stipulated.

Expand infrastructure and openness to support the space industry, which is in the early stages of the industry. Information on the space development infrastructure owned by public institutions will be disclosed and the opening performance will be checked to maximize the use of infrastructure.

In order to create a self-sustaining space industry ecosystem, procedures such as the requirements for designation of the space industry cluster, the requirements for cancellation of designation, and notification to related organizations were stipulated.

The Ministry of Science and Technology plans to collect opinions submitted during the notice period, conduct a review by the Ministry of Legislation, etc.
