Imran Khan’s request to immediately stop the jail trial in the cipher case was rejected

The Islamabad High Court has issued a notice for December 20 on the application for injunction while rejecting the plea to immediately stop the cipher trial against former chairman Pakistan Tehreek-e-Insaf (PTI) Imran Khan.

Islamabad High Court judge Justice Mian Gul Hasan Aurangzeb heard a plea against lack of due process to stay proceedings in the cipher case, challenging the trial court’s December 4 order on the jail trial.

Imran Khan’s lawyer Sikander Zulqarnain said that the court had ordered a transparent and open trial of Imran Khan in jail, but no such notification has come out from the government yet.

The lawyer said that the jail trial of Imran Khan should be stopped until the government follows the court order. The court inquired from the lawyer whether the judge had also received any notification, to which the lawyer expressed ignorance.

Rejecting the request to stop the jail trial, the court has asked the government to reply by Wednesday regarding the implementation of the court order.

During the hearing, Imran Khan’s lawyer said that it is the job of the government, not the judge, to choose the place for the court, to which Jamia Gul Hasan Aurangzeb remarked that it is the judge’s prerogative.

He said that this judge can choose jail for the trial but it should be an open court.

Imran Khan’s lawyer said that the judge did not have the notification of approval of the jail trial. When the order was passed on December 4, the concerned judge wrote in the order that the notification should be submitted.

He said that when the notification of the jail trial was not before the court, how could they pass the order after hearing it?

Imran Khan’s lawyer requested that the court stop the trial until the next hearing. The court said that the report should come and then we will see.

Zulfiqar Naqvi, the prosecutor of the case, said that three government witnesses, who are employed by the Ministry of Foreign Affairs, will be produced today in the Cipher case. He said that the statements of these persons had been recorded earlier.

However, since Cypher’s trial was void, his statements will be re-recorded. The court adjourned further hearing of the case till December 20.
