Imran Khan and Bushra Bibi arrested in a new case after being released in the Iddat case

Imran Khan and Bushra Bibi arrested in a new case after being released in the Iddat case

A district court in Islamabad on Saturday allowed the central appeals once morest the sentence once morest Pakistan Tehreek-e-Insaf (PTI) founder Imran Khan and his wife Bushra Bibi in the Iddat Nikah case. Shortly following the acquittal, the National Accountability Bureau (NAB) arrested him in fresh cases.

According to Deputy Director of NAB Mohsin Haroon, Imran Khan and Bushra Bibi were arrested in the new cases of Tosha Khana. Imran Khan’s sentences have already been suspended in two cases related to Tosha Khana, while the Islamabad High Court has acquitted him in the cipher case.

PTI Chairman Barrister Gohar Ali Khan had told the media that Imran Khan should be released today following the court order to release him in the Iddat case today. However, in new Toshakhana cases, they are unlikely to come out immediately following arrest.

Tehreek-e-Insaf said in a brief statement that ‘Imran Khan has been arrested in three new cases. The Anti-Terrorism Court of Lahore approved the request for the arrest of Imran in the May 9 case.

Tehreek-e-Insaf has termed the new cases as ‘another tactic’ to delay the release of Imran Khan. PTI says that all cases of May 9 incidents once morest Imran Khan were made on the testimony of police officials.

After Accountability Bureau officials arrived at Adiala Jail today to question Imran Khan’s wife in a corruption case, PTI said in a social media post: ‘To destroy their (Imran Khan and wife’s) reputation completely. And NAB should be ashamed for carrying out illegal activities.

After the verdict in the Iddat case, Barrister Gohar Ali Khan while talking to the media in Islamabad said that this was the last case once morest Imran Khan, so he should be released today.

He said that Imran Khan is already out on bail in the Qadir trust case, while the Iddat case was the last case in which he was acquitted.

He said that Bushra Bibi has also been granted bail in other cases.

Barrister Gohar Ali further said that he met Imran Khan in Adiala Jail today who expressed his happiness over the decision regarding the reserved seats of the Supreme Court.

Pakistan Tehreek-e-Insaf leader Zulfi Bukhari said that Imran Khan and Bushra Bibi have already been granted bail in the Tosha Khana case.

He further said that in the Iddat case, the court annulled the sentences of Imran Khan and Bushra Bibi and ordered the release of the husband and wife.

“Currently, there is no case once morest Imran Khan and Bushra Bibi, due to which they can be detained.”

He demanded that both the husband and wife should be released today.

Will Imran Khan be released?

Despite the acquittal in the Iddat case, the release of Imran Khan does not seem possible because an anti-terrorism court in Lahore has rejected the bail of the former prime minister in the May 9 incidents on July 9.

The Punjab Police had included Imran Khan’s name in several FIRs in connection with the May 9 incidents, including attacks on Jinnah House, Lahore Corps Commander’s residence, Askari Tower and Shadman police station.

On July 9, the Lahore Anti-Terrorism Court rejected the pre-arrest bail applications related to these cases.

However, immediate release of Bushra Bibi is possible as there is no other case once morest her, which requires the arrest of the former first lady.

Bushra Bibi had two cases once morest her, out of which she has been acquitted in the case of marriage during Eid, while she has already been granted bail in the £190 million case.

Earlier, the Islamabad High Court suspended the sentences of Imran Khan and Bushra Bibi in the Tosha Khana case.

What happened in court today?

Today, Additional Sessions Judge Afzal Majuka started the hearing on the appeals, while Chaudhry Asif Zahid, the lawyer of Bushra Bibi’s ex-husband Khawar Manika, continued the arguments.

The lawyer said that Bushra Bibi has stood by her husband in difficult times while her husband (Imran Khan) is saying that he does not know.

He said while reciting poetry during arguments:

Love for the killer, compassion for the victim

Tell me who will ask for the reward of love?

Sajdah to the Creator, and Yarana to Iblis

Who will ask for the reward of devotion in the fate?

Lawyer Chaudhry Asif, referring to various court decisions regarding giving verbal divorce, said: ‘Documents take precedence over oral speech, where did Bushra Bibi say that she had completed her ‘iddah?

‘Bashri Bibi has not told Mufti Saeed anywhere that my ‘Idah has been completed. On the other hand, it was said that the woman’s statement will be final, Bushra Bibi told Mufti Saeed that my period has been completed.

Judge Afzal Majoka inquired that ‘how can you use his statement once morest him? Fulfillment of Shariah requirements has been mentioned. I will also disagree with you that such a thing was not expected from a senior lawyer like you.’

The lawyer replied ‘Everyone has a right to disagree and you can too.’

An unusual situation was witnessed during the hearing of the case when Khawar Manika’s lawyer spoke referring to YouTubers.

The lawyer said here in the entire record, Bushra Bibi has not said anywhere that she got married following the period of Idda ended. Social media YouTubers have created such an atmosphere that a woman’s word is final.

The judge made a dialogue pointing to the journalists, ‘These poor people are doing their duty.’

Saqib Bashir, a journalist associated with the TV channel called 92 News, replied, ‘Sir, we are not poor, we are professional journalists. Completing in a responsible and impartial manner. Such a thing gives the impression that we are third class people of any society.’

Judge Afzal Majoka replied ‘No, I meant that we are all professionals and are accountable to some extent.’

In the hearing, the lawyer asked a question, ‘Where is it written that Bushra Bibi said that I did not get married during Eid? It was said several times that Bushra Bibi’s statement will be final.

Lawyer Usman Riaz said that in the statement of Section 342, there is the statement of Bushra Bibi in question number two.

Khawar Manika’s lawyer said that an objection was raised that a photocopy of the divorce certificate was presented to the court, it was written in the witness statement that a copy of the copy would also be acceptable. Tampering was alleged.

It might have been checked, the lawyer said. ‘I looked at it carefully, I didn’t see any tampering. The Qur’an says that a woman can get married when she completes her “Idah.”

Reference to period of Idda

Bushra Bibi’s ex-husband Khawar Manika’s lawyer, referring to the Supreme Court’s decision regarding the period of Iddah, said that in the Supreme Court’s decision, it is written that until the period of Iddah is completed, she is considered the wife of the divorced husband. Will be. In the year 2019, the Islamabad High Court gave a decision in which it was written that the period of Idda will be considered as 90 days.

The lawyer said, “If the woman marries a second time during Idda, she will be in two marriages at the same time. The divorce on November 14 was not challenged by her.” Why was there a need for a second marriage when the first marriage had already taken place? This means the first marriage was a fraud. The law is clear that if two marriages took place, the first one was once morest the law.

With that, the lawyer concluded his arguments by pleading for the conviction to be upheld.

Founder PTI Imran Khan’s lawyer Salman Akram Raja started the arguments. He said that not issuing a notice to the Chairman Union Council can be another crime but it cannot be fraud.

If the notice of divorce is not given by Khawar Manika then the question of 90 days does not arise, read section seven of the Muslim Family Law it is written that notice is not a mandatory condition.

Salman Akram Raja said, “Even if his words are accepted, it can be called a legal marriage, it cannot be called a fraudulent marriage.”

He said, ‘If there is a divorce, what does it mean that Khawar Manika and Bushra Bibi are still married? Because the notice has not been done yet. According to section seven, even today divorce is not given by notice in the village.

The lawyer said that the photocopy of the divorce letter dated November 14, 2017 was produced as evidence, the documents of that date might not be produced as evidence. There is no document regarding when Idda started? The woman says it’s April and says it happened on November 14, 2017.

‘The case is that they say that the marriage would not have taken place on this date but it would have taken place on such and such date.’

Bushra Bibi’s sister Maryam Riaz Vito also denied the allegations once morest her sister in an interview given to Independent Urdu in February this year and said that Bushra Bibi went to her home following completing the Eid according to Islamic laws. Then they got married.

At the same time, he said that the reason for Bushra Bibi’s divorce from Khawar Manika was the insulting behavior of her ex-husband.

And according to him, fed up with this situation, he divorced his wife on November 14, 2017.
