“I passed the exam this week. Now I need a decision of the Bar Council to enter me in the list of lawyers, then there will have to be an oath, other formalities, and finally – entry in the list of practicing lawyers”, E. Misiūnas told BNS.
Those procedures could take several more months, he said.
The former interior minister said that he has not yet decided what field he would like to be a lawyer in.
“According to my scientific field, I am a specialist in public law, all administrative law, state management, civil service, administrative offenses. As a judge, I worked as a specialist in criminal law. I have also worked for seven years at a legal aid center where there is a lot of civil law”, said E. Misiūnas.
“I think about where my strength could be. (…) But we will see where fate will lead, what will be the first, second, third case,” he added.
The lawyer also said that he has not yet decided whether to join the existing law firm or to create his own.
“I have some thoughts, maybe at someone’s office. I’m thinking of maybe creating a “Missionary Political Cooldown Law Firm”. Maybe it wouldn’t sound bad at all. Of course, I don’t know if it would work out from a practical point of view, or if it could be registered like that at all, but jokingly: why not?” the ex-minister thought.
E. Misiūnas was appointed as a judge of Vilnius city district court in 2015. In December 2016, he became the Minister of Internal Affairs and held this position until August 2019, after which he was the Deputy Minister of National Defense until December 2020.
In 2020, E. Misiūnas participated in the Seimas elections with the Lithuanian Peasants and Greens Union and, when he was not elected, in December he submitted a request to the National Judicial Administration to re-appoint him as a judge of the District Court of Vilnius City.
However, President G. Nausėda did not grant his request. The Presidency then stated that “persons who interrupted their judicial career due to participation in political activities or appointment to political positions, and seek to restore it without losing their political positions”, do not meet the principles and motivational criteria of political neutrality.
After two years, the president agreed to return E. Misiūnas to the judges and sought the advice of the Council of Judges, which gave a positive answer. Nevertheless, G. Nausėda did not appoint him as a judge again.
The lawyer says that he will not try to become a judge in the near future.
“As long as there is this gentleman in the Presidency, who is particularly unfavorable to me, I am certainly not going to apply for more at this stage,” said E. Misiūnas.
“How much can you mock me with this attitude?” he added.
The former minister is suing in the courts for not being reinstated as a judge, and he has also appealed Lithuania to the European Court of Human Rights.
E. Misiūnas is also suing for the psychological violence he suffered at the Center for Strategic Analysis of the Government, the damage caused by illegal dismissal, and the reduced additional salary.
