If you want to keep the license plate, it can be transferred free of charge to the name of the spouse/legal cohabitant or one of the children of the deceased, whether to register the deceased’s car or another. To do this, you must complete the registration application form and attach an insurance sticker as well as a copy of the death certificate and the certificate of inheritance. This transfer (which cannot be done online) must take place within 4 months of the date of death. You must make an appointment at the DIV counter (02.277. 30. 50).

Don’t forget to report these changes to the insurance company.

If you do not wish to use the license plate of the deceased, you must delete it by returning it to the DIV. Cancellation is immediate and free. You can then cancel the vehicle insurance contract by sending the company copies of the cancellation notice and the death certificate. Road tax and insurance premiums will be refunded pro rata to the months remaining from the date of death until the end of the period covered by the tax or insurance.

From the moment the car is uninsured or no longer insured, it cannot be on public roads.

Be careful, if you do not know what the estate contains and if you want to be able to renounce it or accept it under benefit of inventory (which is prudent), you must avoid taking certain actions. In effect, if you perform “acts of disposal”, for example, using the car of the deceased, you behave as if you own it and the law then presumes that you have accepted the succession.
