The counselor Carla Humphrey He pointed out that he has no legal impediment to aspire to the presidency of the National Electoral Institute (INE), so it is expected that the Electoral Tribunal of the Federal Judiciary (TEPJF) will reinstate him in the selection process.

According to the legal analyzes carried out by the counselor and her team, both the Constitution and the different laws on the matter, including the regulations of the current call, “fully endorse the aspiration.”

He warned that, to prevent him from seeking the presidency, it would be under “abstract criteria and without support in any legal order.”

One of his arguments is that “the functions of the president of the INE are diametrically different from those performed by an electoral advisor; Therefore, since it is not the same position, the concept of re-election might not be configured, as suggested last Friday by the members of the Technical Evaluation Committee.

In addition, he said, “the members of the respective plenary sessions have the right to aspire to their presidency; hence, a refusal for him to participate in the process would be violating fundamental rights”.

For the counselor Carla Humphrey, her aspiration is endorsed by the constitutional text and that of all the regulatory frameworks that intervene in this selection process, therefore, she asserted, it would be “worrying, for the process itself and for the legal field in general , than the decision of the Court”.
