A woman surnamed Cui in mainland Shanxi Province was officially regarded as a “gang boss” because of her husband surnamed Nie. She was also detained for 328 days and was eventually released without charge. Afterwards, she was so angry that she filed for national compensation, but she did not expect to receive only 122,376 yuan (regarding NT$559,000) in compensation, and would file an application for reconsideration.
According to a report by the Lu media “Beijing Youth Daily”, Cui’s 65-year-old husband, surnamed Nie, once served as the director of a neighborhood committee in Zhongjiazhuang Sub-district Office, Jincheng City, Shanxi Province. Seven counts of organizing and leading a triad organization were sentenced to 25 years in prison, while the remaining 20 or so younger brothers were sentenced to 12 years and 6 months to 11 months.
As for Cui Nv, who was arrested not long following her husband was arrested, the Gaoping City People’s Procuratorate believed that Cui Nv was suspected of participating in a triad organization, so she was prosecuted. On July 30, 2021, the Gaoping City People’s Procuratorate determined that Cui Nv knew that the organization was an underworld organization with insufficient evidence and did not meet the conditions for prosecution, so she was not prosecuted and released.
Afterwards, Cui Nv thought she was innocent and was quite dissatisfied with being detained for 328 days, so she applied to the prosecutor for state compensation, including compensation for personal freedom, consolation for mental damage, etc., totaling 1,239,581 RMB (regarding NT$5,666,000). .
The prosecutor of Gaoping City, Shanxi pointed out that Cui Nu was not physically harmed during the detention, and the compensation for mental damage did not meet the regulations, so it was decided to pay only 122,376 yuan (regarding NT$559,000) as compensation for personal freedom. In response, lawyer Cui Nv responded that Cui Nv was ready to file an application for reconsideration with the Shanxi Jincheng Procuratorate, the higher-level organ of the Shanxi Gaoping Procuratorate.
