How telephone canvassing hours are (finally) regulated

The battle once morest cold calling has been intensifying for several years. Since the Bloctel opposition list does not seem to be enough to curb the enthusiasm of specialized companies, the government is stepping up measures to strictly regulate the practice.

Prohibition of canvassing for the energy renovation sectors, then professional training, reinforced consumer information in terms of insurance prospecting, strong financial penalties in the event of abuse or even sorting of telephone numbers that call platforms have the right to use, the legislator acts on all fronts.

In line with this user protection policy, a new decree, resulting from the law of July 24, 2020 aimed at regulating the practice, has completed the panoply in place by limiting cold calling to specific time slots.

Since March 1, 2023, calls for unsolicited commercial prospecting purposes are indeed prohibited on weekends and public holidays, as well as early in the morning or late at night.

Telephone canvassing is thus only authorized from Monday to Friday, from 10 a.m. to 1 p.m. and from 2 p.m. to 8 p.m. In addition, the same number cannot be called more than 4 times per month by companies.

And if the exasperated consumer ends up picking up to refuse this canvassing orally, he cannot be contacted once more for 60 days.

In the event of non-compliance with these rules, do not hesitate to report the company on Signal.conso.gouv.fr, knowing that it risks a fine of €375,000.
