House Squatting in Uccle: Legal Procedures and Challenges for Property Owners

A resident of Uccle was surprised to see a group of people occupying a house in her town. Particularity of the facts: the property is for sale. The price displayed is significant: several million euros. Worried, she pressed our orange Alert Us button to report the facts. “The police tried to effect the eviction without success. An absurd situation which once once more shows the administrative burden“, reacts Naelle.

Contacted by us, the mayor of Uccle confirms. He said he went there with social services to meet the occupants and manage the situation. Boris Dilliès explains that regarding thirty people, Moldavian families, are squatting in a large house. Some of the people in question are economic refugees who came to Belgium following the war in Ukraine (Moldova shares a border with the country). Others have an order to leave the territory.

The mayeur indicates that no incident has been reported and that the occupants seem very respectful of the place. The police have been informed and will conduct daily rounds to ensure that everything is fine and to reassure the neighborhood, according to the elected official.

As for the owner, it would be an Italian living in Morocco. He would have launched legal proceedings to lead to the eviction of the squatters.

The place of occupation is an important data

Even in the case of illegal occupation of a property, the police cannot evict the squatters on their own. In this case, they occupy private property. It is therefore up to the owner of the premises to initiate the eviction process. A unilateral petition before the court of first instance must be filed indicating the urgency of the situation. The president of the court of first instance then rules on the basis of the documents and the request. The duration of his analysis depends on the size of the file. In the fastest cases, an eviction order can be issued within a day. The decision is then notified by bailiff to the occupants of the premises. If the individuals do not cooperate, then he can call the police, who can use force to evacuate the site.

Apart from this procedure, the police can only intervene in the event of flagrante delicto or of risk to the human person (danger, aggression or fire).
