MIAMI.- A man of Florida was arrested for exercising medicine no state license. Damián Beltrán Garcés, a 52-year-old resident of Hialeah, worked as a doctor at a care center in Miami Lakeswhere, among other tasks, he gave Botox injections to patients.
The Miami-Dade County Police reported that the state health authority reported an alleged individual who practiced medicine without the required authorization or faculty in Miami Lakes.
According to the police report, undercover police officers made an appointment with Beltrán Garcés and during the consultation they agreed to give Botox injections and a price for the procedure.
Minutes later, Beltrán-Garces left the room and returned with the Botox dose to be applied.
At that point, officers proceeded to make the arrest.
According to the police statement, the man admitted that he was not licensed to practice medicine in the state of Florida.
In fact, state law dictates that when the alleged incident does not cause serious bodily injury, practicing without a license is a third degree felony, with a maximum penalty of up to five years in prison and a $5,000 fine.
If convicted, the offense also carries a mandatory minimum sentence of one year in prison.
Should the incident result in “serious bodily injury,” the practice of health care without a license is elevated to a second degree felony, with a maximum penalty of up to 15 years in prison and a $15,000 fine.
That offense also carries a mandatory sentence of at least one year in jail.
