Health Agonizes

Colombia does not have a president, but its destiny is in the hands of a character who, using democracy to reach the presidency, now intends to be a dictator, in the style of Chávez, Maduro, Ortega, among others, as emerges from his continuous actions. and speeches in which, in addition to confessing that he is the natural leader of the first line that set the country on fire in 2021.

He is unaware that he is the leader of a democratic country, a system that is characterized by the division of powers, as a political principle of the form of government, in which the executive, judicial and legislative powers of the State are exercised by different autonomous and governing bodies. independent, who must always exercise their various functions in harmonious collaboration, as provided for in article 113 of our Political Constitution.

Thus, the principles of division of powers and harmonious collaboration between them have an analytical foundation for the fulfillment of the constitutional plan, which is none other than the cooperation and coordination of the different bodies that make up the state apparatus with the objective of satisfying the realization of the state purposes, not the subordination and/or disrespect of one of them with respect to another, since such a context disfigures the balance that must reign between them and breaks the Social Rule of Law.

And precisely that game of checks and balances that must exist in democracy is what the president continually “traps” by trying to get the other branches of public power to submit to his will, concentrating all the power in him and repressing freedoms. individuals, what is called dictatorship.

In that area, at all costs, he sought to impose his health reform. It is known that what starts badly ends badly. The government chose to process this reform as an ordinary law and not as a statutory law, which was appropriate since it was a fundamental right.

Despite this, the health reform complied with the debates in the House of Representatives and was approved. The next step was the discussion and study in the Seventh Commission of the Senate. This Commission is made up of 14 senators, of which 9 announced and signed that they would vote negatively on the presentation.

All kinds of pressure and maneuvers began to try to obtain approval.
The government announced an alternative presentation, trying by this means to reach the Plenary and seeking, in conciliation with the House of Representatives, to obtain the much desired approval. It didn’t work for him.

On the eve of the vote on the negative report, an event of immense gravity occurred. In a hasty manner, with a questionable motivation that might amount to a crime, the Superintendent of Health, Dr. Luis Carlos Leal Angarita, through resolution 2024160000003002 of April 2, 2024, ordered the immediate takeover of assets, assets and businesses and the forced administrative intervention of the EPS SANITAS, separating its legal representative and its board of directors. This is what most people see as expropriation.

This was, there is no doubt, retaliation for what was happening in the Seventh Committee of the Senate, undue pressure to the detriment of the health of Colombians in order to ensure that the reform did not collapse.

When the shipwreck of the Wilson Arias Castillo project became clear, based on article 166 of law 5 of 1992, he filed an appeal. It is regarding getting an accidental Commission to decide whether to admit it and a constitutional Commission to rule on it.

But not only the appeal was given. It also happened that the questionable health minister ran to say that the de facto constituent that the government intends to hold would approve the sunk reform. The president spoke in the same sense, which is extremely serious.

Given the facts presented and the irregularities allegedly committed in the course of the takeover of Sanitas, the Attorney General’s Office, as appropriate, opened a disciplinary investigation once morest the superintendent. After the visit, it was established that there is no file that supports the intervention in Sanitas, a situation that was made known to the country and that, due to its repercussions, frightens it.

Even more so when the NEW EPS was also intervened and it is speculated that the same will happen with SURA. For its part, COMPENSAR, in a statement dated April 5, reported that it was requesting approval from the superintendency to “totally and voluntarily withdraw said program from the Social Health Security System.”

The presidential wish to collapse the health system, leaving aside the life and health of patients, was fulfilled. In March 2023, Petro had anticipated in an interview with Cambio that EPS would fall like dominoes. He announced his intention to keep the health and pension resources. What happened to EPS Salud Capital during the Petro administration? It’s worth remembering.

On the contrary, the 2020 pandemic showed that the health system worked. But what distinguishes Petro’s management is annihilating everything that works and if he did not manage to destroy it with the reform, he has already begun to do so with interventions allegedly outside the law.

This leaves us with a question: who is going to answer for the deaths that are going to occur?
The entities that intervene invariably deteriorate their services and several end up in liquidation.

What to do in the face of such a panorama? Sue, of course. And march.

It is key that the impeachment trial that has Petro desperate move forward because it is very likely that the violation of limits will be proven and the loss of office due to indignity will be imposed, in application of article 109 of the Constitution.
