Marcos P. (33) had his hands and all his clothes stained with blood when the Santa Fe Police arrested him for the femicide of his partner, Isabel María del Luján Peró (39). It was Tuesday, June 30, 2020, on the first floor of a building located at 1200 San Lorenzo Street, in the center of Rosario.
The murderer did not spend a single day locked up in a jail, despite the fact that he came to trial accused of the crime of “qualified homicide” for the link. On the day of the incident, he was taken to a police station and later to the Agudo Ávila Hospital, where he has been for three years.
According to judicial sources, the situation of Marcos P. will not change immediately, because the judges of First Instance, Patricia Bilotta, Hebe Marcogliese and José Luis Súarez, acquitted him of not being held accountable “arranging as a security measure his hospitalization and treatment in an establishment of mental health with a time limit of six years.
Screams and death. Isabel and Marcos argued strongly on the night of June 29, 2020, according to different neighbors. Around one in the morning the other day the police arrived. There were no more screams or fights.
The victim’s body was found in the kitchen of 1st “B”, over a huge pool of blood. Marcos was all bloody, and in an apparent drunken state. “We looked at the shield of the couple’s home and she was lying on the floor. She cut his throat with a knife, ”said a neighbor at the time. The defendant was arrested for femicide.
In the trial, which began on June 23, the prosecution highlighted the medical opinion that revealed that the man “cannot be tried” and that he will continue with his treatment “by virtue of the affectation of consciousness due to an alteration of the faculties that prevented him from understanding the criminality of his acts.”
What is striking is that since the case began, the prosecutor Georgina Pairola, in charge of the investigation, had attributed to Marcos P. the crime of “qualified homicide for mediating gender violence with reiteration of aggravating and harmful behaviors.”
Ezequiel Torres and Luciano Zisele, lawyers for the defendant, requested the acquittal of their client, arguing that at the time of the femicide Marcos P. “might not understand the criminality of his acts, a premise accredited with the reports of the Mental Health Board and a private expert ”.
“The facts were very confusing. In the trial they did not prove themselves, it is not known if he killed her or not, we ask that he be tried for legitimate defense or for violent emotion, because there was aggressiveness on one side and on the other. Both Marcos and his ex-partner were drug and alcohol users who might have generated a context of violence and lack of control, ”Torres assured PERFIL.
