The new trial of film producer Harvey Weinstein, whose 23-year prison sentence for sexual crimes was overturned last April, will be held on November 12, Judge Curtis Farber announced on Friday, adding that the date is still “tentative.”
A preliminary hearing on procedural issues will be held in September.
The judge told his lawyers that he is willing to bring forward the date of the trial – as requested by the defense – if the prosecution presents new evidence incriminating him, and specifically new testimonies from women who have been victims of his abuse.
The 23-year sentence imposed on Weinstein (who is 72 years old) was overturned because, during the trial in which he was convicted in 2020, the judge improperly called several women who considered themselves victims of the producer to testify when the accusations they made were not part of the facts being tried.
Despite the annulment of the conviction, the producer, who is in a very poor state for his age (he uses a wheelchair), remains in prison because he is serving another 16-year sentence handed down by a California court, also for sexual crimes.
Weinstein’s first trial sparked the #MeToo movement in the United States and around the world, in which women from all over the world came forward to denounce situations of abuse of power by male bosses or colleagues in the workplace.
