German Legal Protection Insurers Grapple with Expensive Fallout of Diesel Scandal

The diesel scandal remains the most expensive damage in the history of German legal protection insurers. “The costs as a result of legal disputes over exhaust gas cleaning in diesel engines have risen to 1.52 billion euros since 2015,” says Jörg Asmussen, General Manager of the German Insurance Association (GDV). This includes legal, court and expert costs.

According to the updated GDV statistics, almost 420,000 customers claimed their legal protection insurance by the end of May 2023 in a dispute with car manufacturers over allegedly manipulated exhaust gas values. That is around 7,000 more cases than last October. “The total amount in dispute for all diesel legal protection cases processed by the legal protection insurers has risen to 10.95 billion euros,” says Asmussen. “The average value in dispute per diesel case has remained almost the same at 26,100 euros.”

Another ruling by the Federal Court of Justice on claims for damages in connection with exhaust gas cleaning is expected on June 26. Depending on the outcome of the proceedings, this could lead to a further increase in the number of cases and litigation costs. (awm)
