The owner of a Volkswagen Touran 1.6 TDI bought in 2013 obtained the cancellation of his contract before the Geneva courts. The vehicle had nitrogen oxide emissions outside the homologation standards, reports the RTS. The Court of Justice thus confirmed on Wednesday a previous cantonal decision once morest which AMAG had appealed.
Seduced by the ecological arguments put forward by the sellers of the Swiss importer, this Genevan bought this diesel model in 2013. But with the revelations of Dieselgate two years later, the man became disillusioned and wanted to part with his vehicle.
Despite a software and hardware update by Volkswagen in 2017, the Touran du Genevois still has nitrogen oxide emissions that far exceed homologation standards.
According to the judges, the cancellation of the sales contract is therefore justified. Driving such a vehicle which does not respect the technical orders makes its owner “likely to commit an offence”, underlines the judgment.
The decision of the Geneva courts condemns AMAG to take back the Touran, to reimburse the customer for an amount of more than 18,000 francs. The group must also pay him costs totaling 8,000 francs and assume the legal costs of the two proceedings.
Contacted by the RTS, AMAG disputes this decision and might appeal to the Federal Court.
