GBI Investigates Officer-Involved Shooting at Atlanta’s Four Seasons Hotel

Atlanta, GA (October 30, 2024) – The Georgia Bureau of Investigation (GBI) has launched a thorough investigation into a shooting involving police officers that occurred in Atlanta, Georgia. The Atlanta Police Department, recognizing the need for an independent review, requested the GBI to oversee the investigation on October 29, 2024. A 70-year-old man was shot during the incident but fortunately sustained only non-life-threatening injuries. Additionally, one officer suffered injuries during the confrontation.

The preliminary information indicates that, at approximately 10:12 A.M., Atlanta Police responded to an alarming report of an individual brandishing a firearm at an employee of the prestigious Four Seasons Hotel. The alarming situation unfolded when the hotel’s residential manager was alerted by a resident regarding disturbances, including items being hurled into the hallway on the 33rd floor. Upon the manager’s arrival, he was faced with Jay Berger, the resident who brandished a firearm at him. Fearing for his safety, the manager retreated to the ground floor to contact law enforcement. Upon arrival, the police found that Berger had barricaded himself inside his apartment. SWAT teams were promptly requested and then arrived at the scene. Within moments, shots were exchanged, as Berger began firing inside his apartment and toward the hallway. During the gunfire, one SWAT officer was injured, allegedly from shrapnel. The situation escalated as Berger moved to the balcony of his apartment, discarding various items into the street below. At a critical moment during the standoff, a SWAT sniper successfully struck Berger. Following the sniper’s intervention, SWAT officers breached the apartment and apprehended Berger without further incident.

Berger was transported to a nearby hospital for medical attention and will subsequently be taken to the Fulton County jail following his release from the medical facility. After the investigation concludes, the GBI will forward the case file to the Fulton County District Attorney’s Office for further review and potential legal action.
