On Wednesday in the Council of Ministers, the federal government presented the tightening of the prohibition law that had already been announced in November. The corresponding amendment has now been sent for review. According to the plans, it will also be punishable if relevant content is posted from abroad with the destination Austria. In addition, if you are convicted under the Prohibition Act, you will automatically lose your job in the public sector.

The amendment was presented by Justice Minister Alma Zadic (Greens) and Constitutional Minister Karoline Edtstadler (ÖVP). In order to be able to proceed even better and more accurately in the future, a working group commissioned by the Ministry of Justice has evaluated which refinements and improvements are needed in the prohibition law, the government said. The working group included the documentation archive of the Austrian resistance, the Jewish community in Vienna, the Central Austrian Research Center for Post-War Justice, the Mauthausen Committee Austria and representatives of science, the legal professions, the Ministry of Justice and the Interior Ministry and the Federal Chancellery.

In addition, it should also be punishable if violations are committed from abroad on the Internet. This brings the law up to the level of the 21st century, according to Edtstadler.

A new regulation in the prohibition law should enable authorities to withdraw Nazi memorabilia – such as an SS ring of honor – without criminal proceedings. The current situation is that items can only be confiscated if there is re-activation. Mere possession is not punishable.

An adjustment is also intended to intensify the fight once morest the trivialization of Nazi terror. For example, it should be possible to take more effective action once morest the wearing of, among other things, yellow modified Jewish stars, as took place in the course of the “corona demonstrations”. To this end, “gross” should be deleted from the term “gross trivialization” in the Prohibition Act. Another goal is to increase the conviction rate for violations of the prohibition law.
