Fsc: the Council of State accepts Fitto’s appeal on the Campania dispute

New act of the fiery dispute between the Minister of European Affairs, Cohesion, the South and the Pnrr, Raffaele Fitto, and the President of the Campania Region, Vincenzo De Luca, over the allocation of the Development and Cohesion Fund. The Council of State, reversing the situation defined by the Campania Regional Administrative Court, agreed with Minister Fitto.
«The Council of State – reports a note from the department – has suspended by order the effects of the sentence of the Campania Regional Administrative Court which had accepted the appeal of the Campania Region».

Let’s talk regarding the cohesion agreement to be defined with the Presidency of the Council. The Council of State has set the hearing on the merits for June 13th. In particular – the note reports – “the Council of State considered the actions of the department for cohesion policies and for the South of the Presidency of the Council to be correct with regards to the ongoing investigation”.

The Government will continue the ongoing investigation

And he further adds: «This means that there has been no failure to fulfill obligations on the part of the Department for Cohesion Policies and the South, and that therefore there have never been the conditions to hypothesize the appointment of a commissioner ad acta, which the same TAR Campania had also indicated it as merely possible”. The Government – announced Raffaele Fitto – will continue with the discussions necessary to define the Cohesion Agreement with the Campania Region, confirming a fully collaborative approach which has already led to the signing of 17 Agreements and progress in the definition of the remaining four.

De Luca: «We will ask for the hearing to be brought forward»

Governor De Luca, in his live social media broadcast on Friday, commented on the ordinance. «The minister had appealed for two reasons: the first was that the Campania Regional Administrative Court is not competent, the second that the matter is complex and 45 days cannot be given. On the first reason the Council said that the Campania Regional Administrative Court is competent, on the second reason it established that there are reasons to suspend the contested sentence and therefore suspends the deadlines set by the Campania Regional Administrative Court, i.e. 5 April. In the same sentence, the obligation of all parties to continue the dialogue by resorting to real discussions to reach the rapid definition of the agreement in compliance with loyal collaboration remains firm. The Council suspended the deadlines following which a commissioner ad acta might be appointed and said that the obligation of all parties to reach the rapid definition of the agreement remains intact”. “As always, we are ready for maximum collaboration with everyone and we expect that the agreement will be reached quickly. – he adds – The public hearing is set for June 13th. We are preparing to ask the Council of State to bring forward the date by at least a month because if we get to June we will no longer have the time to do the cultural programming and therefore the programming for the Giffoni Film Festival and the Ravello festival will be skipped, for example”. “What seems important to me regarding this ordinance is this important invitation to a rapid definition of the agreement”, he concludes.
