The battle continues between the Campania Region and the Government regarding the development and cohesion funds. In recent days, the Ministry for the South, European Affairs, Cohesion Policies and the Pnrr filed an appeal with the Council of State once morest the decision of the Campania Regional Administrative Court which had accepted the Region’s requests, setting 45 days within which to sign the Cohesion Agreement.

This is in fact the subject of the dispute. The President of the Region, Vincenzo De Luca, has long denounced the ministry’s delays in the disbursement of funds amounting to 6 billion. Minister Raffaele Fitto claimed that Campania is behind in spending and in formulating programs. The data just published by the State General Accounting Office do not allow us to have a complete picture of the payments from the Development and Cohesion Fund for all the regions, while for the programs co-financed by the EU, Campania is perfectly in line with the national average (74% on payments of the 2014-2020 programming) and well above the average 66% of the programs managed by the ministries.

Three disputed points

The appeal in second instance is based on the same arguments made in first instance: territorial incompetence, inadmissibility of the appeal, unfoundedness of the appeal as there was no silence or delay in the definition of the agreement as the preliminary investigation activity is still ongoing as demonstrated by the interlocutions that took place and from the documentary additions requested from the Region.
