From January 1, work stoppage without waiting day for women in the event of miscarriage

Experiencing a miscarriage and losing three days of salary was a double punishment that many women had to face. This will no longer be the case from January 1, 2024.

Indeed, in the event of a classic work stoppage, the patient has, unless decided otherwise by his employer or the collective agreement, three days of waiting, in other words unpaid. A law adopted on June 29, 2023 provides for a “easier sick leave” in case of miscarriage.

This text establishes the fact that this judgment without a waiting day must apply to all women, whether they are professionals in the private or public sector, independent professionals or non-agricultural employees.

Miscarriage refers to the spontaneous termination of pregnancy during the first five months. It causes vaginal bleeding, pain and can have serious psychological consequences.

Support for women and their partners

Another measure provided for in this law should take effect by September 1, 2024: the establishment of a support program for women and couples who are experiencing a miscarriage.

This route will be coordinated by the regional health agencies which plan to install “a multidisciplinary course to support women and, where applicable, their partners facing a spontaneous termination of pregnancy.“The objective will be to facilitate”medical and psychological monitoring of women and their partners“.

Finally, this law provides protection once morest dismissal for women who experience a late miscarriage (which occurs following the first trimester). The employer cannotterminate the employment contract of an employee during the 10 weeks following a medically certified spontaneous termination of pregnancy which took place between the 14th and 21st weeks of amenorrhea inclusive.”
