Fraudulent and negligent Krida: ex-boss of Lungauer Biofleischerei sentenced to imprisonment

Fleischerei Lungau GmbH was founded in October 2018 – and went bankrupt less than three years later.

One year of unconditional imprisonment for fraudulent Krida, grossly negligent impairment of creditors’ interests and withholding of employee contributions to social security: This was the already legally binding judgment on the former de facto managing director of Fleischerei Lungau GmbH on Tuesday. The said organic butchery was founded in October 2018, including a guest room in the Lungau; subsequently, a market stall and later a restaurant in the city of Salzburg were added, as well as an organic mountain hut. However, the company was already insolvent in mid-2019 – it was closed in 2021 following around 100 creditors had asserted claims totaling 1.5 million euros.

In the process that opened in autumn 2022 (presiding: Judge Gabriele Glatz), the accused Lungauer, who had a considerable previous conviction (defender: RA Franz Essl), was accused of a “lazy” offsetting of expenses between Fleischerei Lungau GmbH and one of its two shareholder companies to have been responsible. Ultimately, the amount of damage in this regard for the creditors was around 39,000 euros.

In addition, according to the indictment, the butcher’s shop was “recognisably insolvent” as early as the end of May 2019 – nevertheless, the expenses for personnel and , among other things, were too high. According to his defense attorney, Lungauer, who has previously been sentenced to several years in prison, will apply to receive an electronic tag.
