Francis Vandy’s Murder Trial: Verdict, Controversy, and Mitigating Circumstances

On August 28, 2019, Francis Vandy surprised Gabriel and Constantin, two Romanians who knew the area, fishing for carp in his private pond near Forchies-la-Marche, near Charleroi.

During his first trial, the jury convicted him of murder for the first shooting and assassination for the second. A judgment then overturned by the Court of Cassation. In fact, she had estimated that given the second shot was only a few seconds apart from the first, there might not be premeditation. However, it is precisely premeditation that makes it possible to differentiate assassination from murder.

Today, the Namur Assize Court therefore ruled. There was no premeditation during the second shooting. Francis Vandy was convicted of murder twice. During its deliberation, the jury accepted the analysis of the Court of Cassation according to which the short period of time between the two shots demonstrated that there was no premeditation. This therefore excludes the qualification of assassination.

In his pleading, Me Charles, Francis Vandy’s lawyer, pleaded two mitigating circumstances. On the one hand, there is “a context linked to the facts“according to the lawyer. The two victims had entered Francis Vandy’s land several times.”There had already been warning shots“. In addition, the lawyer reiterated that his client’s state of health was not good. “He is recognized as more than 70% disabled“.

In its judgment delivered Friday, the court took into account the extreme seriousness of the facts, which caused the violent death of two men, and the consequences for the victims’ families. But also “audacity, determination and violence” demonstrated by the convicted person, when only his right to property was infringed.
