OLG confirms FPÖ Vienna accusation of incorrect reporting – Standard editor Schmid can be described as a “political activist”.
Vienna (OTS) – “Der Standard” and its editor Schmid have embarrassed themselves to the bone with a slap lawsuit once morest the FPÖ Vienna. Schmid and Standard Verlagsgesellschaft mbH wanted to do so regarding the OTS
enforce an injunction prohibiting the claim that they
• ran a negative campaign once morest the FPÖ MP Udo Guggenbichler,
• and/or the plaintiffs had prejudged Guggenbichler through their reporting,
• and/or the plaintiffs’ reporting only serves to defame liberal mandates,
• and/or there is no emphasis on accuracy in the plaintiffs’ reporting,
• and/or the plaintiffs had once once more launched a malicious defamation campaign,
• and/or the second plaintiff (Note: Fabian Schmid) would act as a political activist in the reporting of the first plaintiff (Note: Standard Verlagsgesellschaft mbH).
After the Vienna Commercial Court rejected the interim injunction in November due to an embarrassing formal error, the Vienna Higher Regional Court has now also rejected the request in all respects.
With regard to the above-mentioned reporting, Standard Verlagsgesellschaft mbH and editor Schmid must, among other things, accept that they did not attach any importance to accuracy and did not report in a balanced manner. What is particularly piquant is that editor Schmid can be described as a “political activist”.
The Vienna FPÖ state party secretary Michael Stumpf: “This judgment clearly shows what kind of sleazy journalism is carried out in this medium. Some editors are not interested in research and balanced reporting, but simply in left-wing campaign journalism once morest unpleasant political opinions. Therefore, the FPÖ Vienna will continue to ignore the reporting of this now completely insignificant medium.”
