Liberals categorically reject the present draft law
Vienna (OTS) – “The only positive thing regarding this government’s COVID-19 Transitional Act is that this time there has been a proper peer review process, gathering in-depth stakeholder input. Unfortunately, only a very small fraction of these were incorporated,” criticized the FPÖ health spokesman and chairman of the parliamentary health committee NAbg. Mag. Gerhard Kaniak today the black-green federal government in his contribution to the debate.
The normality that the Freedom Party has long demanded will not be restored at all. “There are still parallel structures, for example in the vaccination system or drug delivery and billing, constitutionally dubious regulations for the assumption of costs, data protection concerns that have not been dispelled, and above all an epidemic law that is still being ‘doctored’ instead of being completely new set up,” says Kaniak.
For example, the epidemic law, which should only apply in the event of a crisis in the case of notifiable diseases, contains further “improvements to make things worse”: “It should now suddenly also apply to non-notifiable respiratory diseases. The government can now also prescribe traffic restrictions or the obligation to wear a mask to citizens with other notifiable diseases, although the usefulness of this, for example in the case of hepatitis C or HIV, is more than questionable. However, the ÖVP and the Greens continue to make further mistakes from Corona policy, such as the notification by telephone for the authorities, which is a legal absurdity, or the further granting of the right to official revision, which means that the state administrative courts can be bypassed. All of these things are unacceptable from a freedom point of view and therefore have no place in the Epidemic Act, ”explained the FPÖ health spokesman.
Since the summer of 2020, the Freedom Party has been calling for the epidemic law to be revised, in which it must be clearly defined when the crisis will occur and when it will come into force in full with all its powers and also be ended once more: “All of this is still not found in this law, but on the contrary, the government is expanding the scope of application, which means that there are neither reasonable rules for emergencies nor protection from citizens once morest improper application of this law. That’s why the FPÖ categorically rejects it!”
