Ashley Gjovikformer Apple employee, filed yet another lawsuit once morest the company — this time under the Federal Law on Corrupt and Influenced Organizationsknown in the United States as RICO Act.
The lawsuit aims to hold Maçã responsible for alleged retaliation once morest Gjøvik following his dismissal in September 2021. With the two-year deadline for possible civil claims approaching, it is now seeking to assert its complaints.
I still have no final decisions on my retaliation charges once morest Apple, and my two-year deadline for many of my potential civil claims is running out tomorrow.
Therefore, I filed a civil lawsuit yesterday. I decided that if I had to face Apple in court anyway, and I only had one real chance to hold Apple accountable for everything they did to me, I might as well include it all — and I did.
In practice, the action covers matters related to retaliation once morest whistleblowers under federal laws such as Sarbanes-Oxley (or SOx)ea Dodd-Frankwhich aim to protect employees who report financial irregularities at US companies.
Gjøvik filed the lawsuit in California — not for nothing, but because of specific claims related to the state’s laws. Among them are the Whistleblower Protection Law and some Civil Rights Laws.
Among other allegations in the lawsuit are alleged violations of the Lei FTC (Federal Trade Commission Act)which prohibits unfair and deceptive business practices in the US, including the misuse of data.
Finally, Gjøvik accuses Apple of committing several illegal actions, including electronic fraud, misuse of postal services, deceptive practices related to financial investments, bribery and extortion.
The lawsuit was filed on September 7, 2023, in the United States District Court for the Northern District of California, and requires a trial. So far, Apple has not commented on the matter.
