Foreign Employees in Transportation: Impact on Employment Rights, Aviation Safety, and National Security

The Taoyuan City Pilot Professional Union, the Sinosteel Express Enterprise Union, and the Republic of China International Airport Union Federation held a press conference in the Legislative Yuan today, calling on the government to immediately face up to and start adjusting wrong policies.

The Pilot Union pointed out that the Ministry of Communications formulated the “Work Qualification and Review Standards for Article 46 Paragraph 1 Subparagraph 1 to Subparagraph 6 of the Foreigner Employment Service Law” in 2004. Article 15 regulates the conditions for the introduction of foreign pilots , “Airlines can hire 3 foreign pilots for every 1 national pilot trained.” In 2010, it was adjusted to “For every 1 local pilot trained, 2.5 foreign pilots can be hired. “

The pilots union approved that the above-mentioned erroneous policy doubled the number of foreign pilots from 200 in 2010 to more than 400, and the number of foreign pilots employed by EVA Air accounted for nearly a quarter of the company’s total pilots, resulting in at least hundreds of pilots. Foreign pilots have long excluded the right to employment of national professionals who have obtained a commercial pilot license (CPL) abroad at their own expense.

In addition, the trade union of Sinosteel Express also complained that for more than ten years, Taiwanese shipping companies have become “expediency ships” by transferring their ships’ flags to other countries (such as Panama and other countries) in order to evade the relevant regulations of the Chinese government restricting the employment of foreign seafarers. And management measures, on the other hand, is to continue to lobby the government to expand the proportion of foreign (mostly Chinese) crew members allowed on ships from open countries.

The trade union pointed out that Sinosteel Express, a state-owned enterprise with state-owned shares, took the lead in abusing and relying on Chinese ships. The trade union said that Sinosteel Express took the lead in placing a large number of ships in other countries, and it will not be required to undertake the obligation of requisition and cooperation in the mobilization stage in the future. Moreover, if the Chinese government compulsorily recalls the ever-increasing number of Chinese seafarers, it will lead to Taiwan’s mobilization period. The urgently needed raw materials for the production of steel products and the import and export of steel products are in short supply, as well as the deadly national security crisis of ships lacking crews.

The trade union jointly appeals that pilots and sailors should give priority to protecting the employment rights of their own nationals, and immediately amend the “Work Qualification and Review Standards for Article 46, Paragraph 1, Subparagraph 1 to Subparagraph 6 of the Foreigner Engaged in Employment Service Law”, and require Air China gradually reduces the employment of foreign pilots; it gives priority to the training and promotion of its own national pilots; the Ministry of Economic Affairs and the Ministry of Communications of the actually state-owned Sinosteel Express Company should ask the company to immediately stop hiring Chinese crew to replace its national crew , and make improvements within a time limit to protect the employment rights of domestic seafarers.
