Ford Ordered to Repay Millions in severance Dispute
The Ghent Labor Court has issued a verdict, concluding a long-standing legal battle between automative giant Ford and the National Employment Office (NEO). The dispute stems from the closure of the ford Genk factory in Belgium in 2014.
Severance Payments: A Point of Contention
Ford,along with four of its supplier companies,argued that the NEO should have contributed to the severance payments for the laid-off employees. Specifically, Ford demanded that the NEO cover the cost of seven additional weeks of notice that ford workers were entitled to under the new law on single status.
A Twist in the Legal Saga
The NEO countered, asserting that these extra payments fell under the category of ’statutory termination compensation,’ a responsibility of the employing company. Despite this, the Brussels Labor Court sided with Ford in both 2017 and 2018, ordering the NEO to make the additional severance payments.
However, the story took another turn in February 2024 when the Court of Cassation overturned the Brussels Labor Court’s decision. The case was then sent to the Ghent Labor Court for review.
Ghent labor Court Rules in Favor of the NEO
Representing the NEO, lawyer Remi Swennen successfully argued for the annulment of the previous judgments and the repayment of nearly 30 million euros in what he deemed unjustified payments. This figure includes 23 million euros owed by Ford. The Ghent Labor Court agreed with the NEO’s position and ruled in their favor.
