For the seventh year, a young mother has been trying to tap the conscience of Kęstas Komski and his family

During those years, Simona experienced everything – bereavement, the trial of the person responsible for the accident, the award of compensation from Kęstos Komski’s company and the bankruptcy of the same company. As it was later established, the bankruptcy was caused on purpose in order to avoid paying compensation to Simona and her children.

Having noticed suspicious circumstances of the bankruptcy of K. Komski’s company “Agrolira” in the “Sienas” investigation, Simona herself initiated a pre-trial investigation. It ended with the former director of “Agroliras”, K.Komski’s son Algirdas, being convicted and awarded unpaid compensation. However, since the court decision came into force, Simona and her children have recovered only a small part of the awarded amount, and the case was recently returned to the appeals instance.

The event that changed everything

in 2017 July 17 a drunk employee of “Agrolira” company, while driving a company car, caused an accident and killed Vytis Šulinskas, a young father of two children who was riding a motorcycle to visit his family, and he himself fled from the scene. in 2019 at the end of February, the Tauragė district court sentenced the worker who caused the accident to five years’ imprisonment and ordered him to pay tens of thousands of euros in compensation to his relatives. He jointly shared the obligation to pay compensation with the now bankrupt company Agrolira of K. Komski, who ran for the post of mayor in Pagėgiai municipality last year.

As before revealed by Siena, “Agrolira” went bankrupt a few months after the court awarded about 100 thousand to the relatives of the deceased. euro compensation. Before the bankruptcy, the bailiffs managed to collect less than a third of the awarded amount from the company – over 2 thousand euros for Simona and the parents of her deceased husband, and 14 thousand euros for each orphan.

After “Sodra” initiated the bankruptcy of “Agroliras” due to the accumulated arrears, the bailiffs’ hands were tied to recover the remaining amount. However, Simona did not give up and, with the help of “Sienas” journalists, decided to move on after piecing together the whole picture of the events. Almost exactly four years ago, a pre-trial investigation into the bankruptcy and waste of assets of “Agroliras” was launched.

When investigating the circumstances of the collapse of the Agrolira company, it was finally proven that the then director of the company, A. Komskis, deliberately drove the company into bankruptcy. in 2023 June 12 by ruling, the Klaipėda District Court convicted A. Komskis of wasting the company’s assets, criminal bankruptcy and fraudulent accounting management.

In the same court decision, A.Komskis was also awarded solid compensation to Simona and her children – the same money, the payment of which was avoided during the bankruptcy of “Agroliras”. However, as Simona says, in reality only a very small part of the awarded amount was recovered after the court ruling came into effect.

When asked why he paid only such a small part of the awarded compensation in half a year, A. Komskis spoke about the bailiffs.

“You know, you should contact the bailiffs here more, because they would probably tell you why the amount is so small. <...> The amount you are talking about was probably much higher there, because the salary of the bailiffs there is still considerable in all of this,” said A. Komskis.

A hazy future

Today, the chances of the relatives of the dead man to recover the compensation they are entitled to seem even more bleak, because on February 28 of this year. by ruling, A. Komski’s case was returned to a lower instance. For the former director of Agroliras, this is an opportunity to be acquitted, and for Simona and her children, it is a sign that the fight for the compensation they deserve and the long-awaited justice is not yet over.

“I am a small cog in that justice system, and maybe someone is bigger and manages to get out of the puddle more dry,” Simona shared her thoughts.

When asked how he assesses the decision of the Supreme Court, A. Komskis gave a laconic answer.

“A good question, probably positive, of course,” the former director of “Agroliras” assessed the court’s decision.

According to Simona, this court ruling is a serious step backwards, which may for some time limit the possibilities of recovering the awarded compensations.

“After the decision of the Supreme Court, in fact, a couple of days later, I received from the bailiffs that the executive case was suspended. <...> I’m not a lawyer, I’m not a specialist in this field, it’s only relevant to me how much time will be needed again, because I’ve been participating in that “beauty” for 7 years,” Simona told “Sienas” journalists.

A tragic incident that killed a young man who was driving to visit his family has turned into a seven-year fight for justice and rightful money. According to Algirdas, the son of Kęstos Komskis, he does not feel guilty for the bloodstained incident.

“My guilt is direct… really, I can’t watch every person, what they do after work,” said the former director of “Agroliras”.

However, A. Komskis assured that after the court marathon ends with an unfavorable decision, he will pay the money to Simona and her family.
