MIAMI, Florida, USA- This Thursday morning, the Judge Aileen Cannon refused to dismiss the charge that the former US president faces in Florida. Donald Trump (2017-2021) by criminal case of the mishandling of confidential documents found in his possession following leaving the White House.
The ruling denies a motion based on the Presidential Records Act filed by Trump’s defense to dismiss the accusation.
The legal procedure sought to dismiss 32 charges of “intentionally withholding and not delivering documents containing national defense information,” as well as the remaining charges related to “obstruction of justice“.
“The Presidential Records Act does not provide a pretrial basis for dismissing” the charges, the judge, who was nominated during Trump’s term, noted in the court document.
Cannon, however, rejected the special counsel’s request. Jack Smith to make a final decision on whether that theory can be used in the trial, which will take place in a court in Fort Pierce, regarding 200 kilometers north of Miami.
The trial, which was scheduled for May 20, is still pending a new date from Cannon.

Trump will most likely be the Republican Party candidate who will face the president Joe Biden in the presidential election November despite the four criminal cases he faces.
