The multi-member Court of First Instance of Athens decided to dismiss the action of Giorgos Kimoulis once morest the Union of Greek Actors and the members of the Disciplinary Council of SEH, Paschalis Tsarouha, Tryfona Zaharis and Yiannis Panagopoulos.
The well-known actor asked the court to award him a total amount of 481,227 euros (for lost profits and moral damage) for defamation he suffered, however the court rejected G. Kimoulis’ lawsuit, awarding him also 8,222 euros in court costs.

In his lawsuit, Giorgos Kimoulis referred to a series of events, claiming that “following the 26/01/2021 TV interview of the actress Zetas Doukas and other complaints by a total of ten different persons, SEH referred him ex officio to its disciplinary body and on 22 /1/2021 notified him of a written complaint, knowing the untruth of the reported incidents, as a result of which disciplinary proceedings will be initiated once morest him and his honor and reputation will be insulted.”

G. Kimoulis was also referring to posts by the members of the SEH Disciplinary Council and to interviews of P. Tsarouha that “created a reasonable and well-founded suspicion of bias, as the case had not been previously investigated”, as well as the way in which of the disciplinary investigation, making, in fact, special mention of a report by the president of the Disciplinary Council “in Tripoli” during the examination of Z. Doukas, in which he “implies that I deserve to be locked up in the Tripoli detention center like the violators of sexual freedom, insulting my honor and respect”.

Examining in detail the arguments of the two sides, the court in the decision cites the formation of the SEH Disciplinary Council for the Kimoulis case, based on the complaints of Zeta Doukas, Katerina Geronikolou, Fanis Pavlopoulos, Evdokias Roumeliotis, Nikos Psarras, Doras Chrysikou, Alexandras Taboularis , Fay Xyla, Bettys Nikolesi and Katerina Papoutsaki (then the actors Tzeni Ioakeimidou, Kostas Arzoglou, Fay Kokkinopoulou and Emilia Ypsilanti were added), for disciplinary offences/anti-colleague behaviour.

Based on these, SEH drew up a written complaint, in which, as judged by the judges, “simply cites the excerpts from the public complaints-interviews, stating that it is requesting a relevant investigation from the Disciplinary Council (…) without stating whether it considers them to be true” .

“Subsequently”, the judges continue, “a disciplinary investigation was carried out according to which the plaintiff’s behavior was judged to be aggressive and anti-colleague with verbal attacks, psychological violence and intimidation and following that the recommendation was to impose the definitive deletion from the SEH, the which was actually decided on 10/4/2022” (based on 8 of the 14 complaints above).

“From all the above it was shown that SEH wanted the clarification and investigation of the case primarily and not the disciplinary prosecution and punishment of the plaintiff”, they report.
According to the judges, it was not proven defamation by Paschalis Tsarouha’s public reference to the previous deletion of G. Kimoulis from SEH in 1998, since this fact was proven to be true, but neither by his reference to Tripoli during the examination of Zeta Doukas, since “from the transcribed minutes of the Disciplinary Council it appears that it refers to an earlier complaint, for which a clear distinction is made from the investigated complaint once morest G. Kimoulis”.

The court also rejected some of the claims of G. Kimoulis for formal reasons, such as his request for payment of an amount he would receive from the Athens-Epidavros Festival, an oral agreement that was canceled following the complaints, because “no incidents are described regarding the certainty of receiving the amount, but also the way of calculating it”.

Finally, the court rejected as unfounded the claims of moral damage, since “these are not insults committed through the press, as such and any social networking media”, while the judges add that “for the offense of defamation, knowledge is required that the spreading fact is false.”

The injunction has already been served on the lawyers (G. Kimoulis appeared in court with his lawyer Vassilis Kapernaros and the SEH representatives with Hara Maroulis, Georgia Palaiologou and Patrikios Patrikounakos) and now, if he wishes, G. Kimoulis has the right to appeal once morest the first instance decision.
