After the rejection of the complaint filed by the municipality of Valparaíso for the failed fireworks display, the director of Valparaíso’s Legal Department, Nicolás Guzmán, criticized the fact, describing it as “unintelligible”, since the same judicial action that presented the municipality of Viña del Mar, was admitted and sent for processing.
This Wednesday, the Guarantee Court from Vina del Mar accepted the complaint for the crime of fraud presented by the municipality of Ciudad Jardín. For his part, he Valparaíso court declared inadmissible the action sought by the municipality of Buenos Aires.
In this way, the judicial process begins for the case sued by the Viñamarina building, being sent for processing. Not so with his port peer.
It should be remembered that, through these actions, Both municipalities seek to sanction those responsible for the failed New Year’s fireworks show, which was canceled.
Complaint filed by the municipality of Valparaíso is declared inadmissible
On the one hand, the Guarantee Court of Valparaíso declared inadmissible the complaint for the crime of fraud presented by the municipality of Buenos Aires.
According to the court document, it was a breach of contract between the municipality and the companies that carried out the show, not a criminal offense as the municipality maintained.
In this regard, from the building house they indicated that filed an appeal against the decision issued by the court.
This was indicated by Nicolás Guzmán, director of Legal Advice, who argued that they presented this legal action so that the investigation by the Public Ministry can begin.
“We hope that this decision can be reversed, which leaves the Municipality of Valparaíso defenseless by not being able to prosecute the criminal responsibility that derives from the facts exposed. And it resolves the matter in advance and contradictory way, ”he criticized.
“Unlike what was achieved by the Viña del Mar Guarantee Court in the face of exactly the same facts and crimes,” Guzmán compared. In that sense, he questioned and said that “It is incomprehensible that the same facts can constitute crimes in Viña de Mar and not in Valparaíso”.
Judicial action of Viña del Mar is admissible
Regarding the acceptance of the complaint presented by the municipality of Ciudad Jardín, which was sent for processing, the legal director of the Viñamarina building referred to it, hoping to start soon with the corresponding investigation by the Public Ministry.
“As a municipality, We hope that the investigation by the Prosecutor’s Office will begin soon. Let those responsible be formalized so that, when appropriate, they are sentenced according to what the Viña del Mar court deems pertinent”, he assured.
Finally, from the Viñamarina building, they stressed that the actions of the company Piromar FX SpA in UTP with Pirotecnia SpA should be investigated. This, emphasizing that These companies intended to use the pyrotechnic elements knowing that they did not meet the technical requirements.
