Fired for eating an expired cookie after feeling unwell: “It’s still difficult to evoke malicious intent”


A Lidl employee was fired for serious misconduct following eating an expired biscuit when she was unwell.

The Lidl store in Legs was blocked from customers on Monday morning to denounce the dismissal of a worker. “In mid-March, a worker at the Lidl store in Legs was dismissed for serious misconduct, therefore without compensation and with an unemployment penalty, following more than 19 years of service… Her fault? To have eaten an expired biscuit following an illness in the reserves”, denounces Thomas Lesire, permanent secretary Setca Commerce.

According to him, the company “refused to review its position”, despite a medical certificate. “We hope that this action will make it possible to relaunch the consultation and obtain justice for this worker, that is to say her reintegration within the company”, specifies Setca.
