The Ministry of Public Finance published a video on social media with the following description: “The Minister of Public Finance, Jonathan Menkos Zeissig, filed an injunction once morest the Attorney General for intimidating and illegal actions.”

The publication is accompanied by a video, which according to the Ministry of Finance, shows the alleged illegal actions of the Public Prosecutor’s Office (MP) in that department.

The amparo action was filed before the Supreme Court of Justice once morest Attorney General Consuelo Porras for alleged illegal actions in Finance.

According to the recording, the MP has carried out “a series of intimidating and illegal actions and since May 29, 2024, it is known that MP prosecutors have carried out investigative proceedings on actions and activities of Minister Menkos, in the exercise of his office, despite the fact that the official enjoys the right to preliminary trial.”

According to the Ministry of Finance, agents from the Anti-Corruption Prosecutor’s Office “have attempted to confront Minister Menkos, forcing him to testify through an unnumbered document.”

He points out that the “MP has carried out a series of actions that constitute a continued grievance once morest Minister Menkos, including official proceedings and investigation files without exhausting the impeachment procedure.”

He claims that “MP prosecutors have used official vehicles to try to illegally enter the Ministry of Finance without a court order.”

He points out that agents of the Anti-Corruption Prosecutor’s Office “have attempted to force Minister Menkos to testify by means of an official document that, from the way it has been drafted, seeks to incriminate both him – the minister – and other officials who enjoy immunity.”

He added that on June 11, the MP “tried to access the minister’s workplace in search of information regarding work meetings.”

According to the Ministry of Finance, these actions have “violated the right to defense, the right to a preliminary trial, due process and the presumption of innocence.”

He stressed that the aim of the protection is to “end all criminal prosecution in the exercise of the minister’s office.”

The MP was consulted to request its position regarding the above and the protection filed by the Minister of Finance and responded: “the right to petition is guaranteed in the Political Constitution of the Republic, however, the legal ignorance and lack of support for your petition is notorious, since the proceedings carried out by the prosecutor’s office were developed in follow-up to an investigation related to the possible offer of money to deputies, in exchange for voting in favor of a budget expansion proposal.”

“The actions taken by the prosecution have not been directed at Minister Jonathan Menkos, who has the right to a preliminary hearing, which is why the ex officio defense that has been generated since the day the proceedings were carried out is striking. If, by virtue of the investigation being carried out, it is determined that further requests need to be made, these will be made as established by law,” he added.
