According to a lawyer specializing in criminal cases, Ayman Mahfouz, the girl and her brother will be subject to the same penalty, which is death, if the criminal intent is proven to deliberately kill the victim, especially since they committed together an act complementary to the crime, which is disposing of the corpse and trying to mislead the security authorities. Egypt had witnessed a similar horrific murder last June as a student named Muhammad Adel slaughtered his colleague, Naira Ashraf, in the middle of the street, because she refused to associate with him, and the court ruled that he be executed.

What is the expected punishment?

Lawyer specializing in criminal cases, Ayman Mahfouz, told Sky News Arabia that the participation of a girl with her brother in killing her fiancé and disposing of his body is a full-fledged murder in accordance with the provisions of Article 230 of the Egyptian Penal Code, which “punishes the perpetrator of premeditated murder.” the death penalty.”

But will the punishment of the girl and her brother be equal?

Mahfouz explained that Article 39 of the Penal Code regulated this matter, stating that “he who commits it alone or with others or who is involved in committing it is considered a perpetrator of the crime, or not, if it consists of a number of acts, and he intentionally commits one of the acts that make it up. The perpetrator of the crime is He who intentionally commits the crime or part of it.

He pointed out that Article 40 of the same law stipulates that “he is considered an accomplice to the crime, the instigator and assistant in the commission of the act constituting the crime.” Article 41 specifies that “whoever participates in a crime must impure its punishment, except for what is legally excluded by a special text.”

The lawyer concluded by saying: “From all of this, it is clear that the girl and her brother will be subjected to the same penalty, which is death, if the criminal intent is proven to deliberately kill the victim, especially since they committed together an act complementary to the crime, which is disposing of the corpse and trying to mislead the security authorities.”
