Federal vs. Flemish Jurisdiction: The Battle Over Brussels-National Airport and Noise Pollution

2023-11-11 11:53:07

A few months before the elections, the Flemish Region is filing an appeal with the Council of State once morest a royal decree of the federal government relating to Brussels-National airport and contesting the jurisdiction of the federal government in matters of noise pollution. Thus, she considers that the rules for the distribution of powers have not been respected, which is formally contested by the Federal Minister of Mobility, Georges Gilkinet, who invokes the need to comply with European rules.

In this text, it is specified that the federal government is responsible for certain operating rules for Brussels-National airport. According to the Federal Minister of Mobility, it is simply a question of respecting a European rule which requires designating the competent authority at the airport: “The sole purpose of this royal decree is to enable the federal government to act once morest noise pollution linked to airport activity in Brussels-National by complying with developments in European legislation. It does not extend the powers of the federal state in the regulation of airport noise pollution.“, specifies Minister Ecolo.

A few weeks ago already, the Flemish Minister of the Environment, Zuhal Demir, initiated conflict of interest proceedings once morest the modification of certain air routes above Brussels and its outskirts. Minister N-VA persists and therefore signs by introducing this new appeal.

By contacting the Council of State, Zuhal Demir intends to assert that Flanders has sole jurisdiction over noise pollution around the airport located in the Flemish Region. The federal government has until December 11 to submit a memorandum to the Council of State, “what he will not fail to do“, assured Minister Ecolo.
