Federal Court Rulings and Provincial Challenges: Impact on Transportation Subsidies and Education Funding

In the last few hours, a southern province achieved a court ruling that stops the national government’s cuts. The Federal Court of Rawson ordered to reverse the removal of transportation subsidies following a claim from Chubut Governor, Ignacio Torres (PRO), who had made the presentation together with the mayor of Comodoro Rivadavia, Othar Macharashvili.

The fact is that this situation can generate a rebound effect in the provinces and even some municipalities. The judicial decision generated a chain reaction in Patagonia, but also in the province of Santa Fe, where different cases are already being studied to present demands to the national State.

In relation to the Nation’s failure to provide educational financing, the Government of Río Negro appeared before the Federal Court of Viedma requesting the regular remission of national funds destined for the province’s educational system. This Thursday, the State Prosecutor’s Office filed an action for protection once morest the National State, the Ministry of Economy and the National Secretariat of Education, for failure to comply with their educational financing duties since January 1, 2024.

As reported by the provincial government, the non-compliance consists of the suspension of the regular remittance of national funds to Río Negro, “violating the right to education enshrined in the National Constitution and various laws.” A ruling was requested ordering compliance with the aforementioned regulations and the reestablishment of financial assistance to the Province. In addition, an urgent precautionary measure is requested to restore the flow of funds while the case is resolved.

In Rosario, the Secretary of Government, Sebastián Chale, acknowledged that they are studying the possibility of making a presentation, although it remains to be seen if they are authorized to do so, since the Compensation Fund reaches the provinces and from there it is distributed to transport companies. .

The removal of subsidies for interior transportation that was rejected by the more than 40 mayors of the country’s main cities, among which is Rosario. The judicial resolution in favor of Chubut occurred on the same day that the Council discussed the emergency declaration for the bus system requested by Mayor Pablo Javkin.
