KARLSRUHE (dpa-AFX) – The Federal Court of Justice (BGH) will decide on Monday (11 a.m.) whether Mercedes buyers have lost any claims for damages in the diesel engine scandal when concluding their car loan. The plaintiff had financed his car through the Mercedes-Benz bank. The signed contract stipulates that the borrower assigns to the bank, as security, among other things, present and future rights once morest Daimler – “in any legal capacity whatsoever”.
The Stuttgart Court of Appeal (OLG) recently ruled that the man was therefore no longer entitled to sue Mercedes-Benz for damages. During the hearing in mid-March, the judges in Karlsruhe hinted that they might see things differently. The clause might inappropriately disadvantage customers.
