An unworthy father from Montérégie, suspected of having transmitted herpes to his daughter, barely eight years old, by repeatedly sexually assaulting her, has just been declared guilty on all counts.

“Despite the twists and turns of his testimony, [la fillette] never deviates from her trajectory: she was the victim of sexual contact and it was her father and no one else who committed them,” noted judge Christian Jarry, at the Saint-Hyacinthe courthouse.

The 40-year-old man, who cannot be named to protect the identity of the complainant, was found guilty in February of sexual assault and sexual assault causing harm.

Suspicions arose in late 2018, when the eight-year-old girl was diagnosed with herpes type 2. She had complained of pimples and pain when urinating.

His parents, newly separated at the time, had been carrying the disease for several years.

Fifteen times

The young victim herself suggested an explanation: her father had sexually assaulted her a hundred times since the age of 6.

“Testifying four years later, she revised the number to around 15, including regarding five times in the bathroom. She specifies that the number 100 was intended to convey the idea that several attacks occurred,” argues Judge Jarry.

The atrocities occurred when the little girl had to apply a cream to her genitals, as she was dealing with complications linked to her urinary infections. Rather than helping him, the offender took the opportunity to satisfy his impulses.

After a doctor confirmed that the complainant had contracted herpes, her attacker assured the Youth Protection Department (DPJ) that he was not the cause of the infection.

To the hospital

However, his fears were so strong that he was reportedly sick and even hospitalized.

The one who completely denied the horrors with which he was accused then testified that he was not aware of his infection before a positive screening in 2019.

It was ultimately the history of his medical file that betrayed him. A first diagnosis was made in… 2014.

The court thus gave “no credibility” to his version of the facts. It was quite different for the young victim, despite inaccuracies and contradictions.

“She expressed herself well for her age, testified in a calm manner and the embarrassment that she experienced, at the time of the filmed statements, when subjects of a sexual nature were discussed, gave her testimony an aura of truth,” he said. recounted Judge Jarry.

The magistrate also mentioned that the little girl had “no reason to falsely accuse her father”.

The unworthy father should receive his sentence later this year. He will return to court next May. Me Isabelle Morin will represent the public prosecutor, while Me Julie Lepage will defend the accused.
